This agreement is accepted by the renter when the booking is made, and recorded against that booking with the version and timestamp.
1. The agreement
This is between the provider and the renter named on the booking. Lendify is not a party to it; it provides the platform, handles payment and administers disputes.
2. The rental
The provider grants the renter temporary possession of the item described in the booking, for the period stated, in exchange for the payment shown. Ownership does not transfer.
3. The renter agrees to
- use the item only for its intended purpose and in accordance with any rules stated on the listing;
- not sub-let, lend or sell the item;
- return it at the agreed time, in the condition received, allowing for reasonable wear;
- report any damage, fault or loss immediately;
- hold any licence the lawful use of the item requires.
4. The provider agrees to
- supply the item as described, in safe working order, with everything listed as included;
- disclose known faults before the booking starts;
- make it available at the agreed time and place;
- hold any insurance or certification the law requires.
5. Condition records
Both parties are encouraged to record photographs and complete the condition checklist at handover and return. These are operational evidence used in dispute review; they are not a legal attestation.
6. Late return
A listing may state a late fee and a grace period. That fee is not charged automatically: if an item comes back late, the provider raises it through the dispute process, and it is settled against the deposit like any other claim. Items not returned within 7 days of the due time may be reported as unreturned, and the deposit may be applied.
7. Damage and loss
The renter is responsible for damage beyond reasonable wear, and for loss or theft while the item is in their possession. Claims must be raised within the provider's inspection window and are settled through the platform's dispute process.
8. Liability
The renter uses the item at their own risk. The provider is liable for loss caused by an undisclosed defect they knew or should have known about. Neither party excludes liability for death or personal injury caused by negligence.
9. Governing law
Governed by the law of the provider's jurisdiction, unless mandatory consumer law says otherwise.
